中國(guó)內(nèi)地的單位或者個(gè)人可以委托依法設(shè)立的專利代理機(jī)構(gòu)辦理專利申請(qǐng)手續(xù)，也可以自行辦理相關(guān)手續(xù)。一般選擇專利代理機(jī)構(gòu)可以省去更多的時(shí)間和精力，但是如何選擇正規(guī)的專利代理機(jī)構(gòu)？

01.專利申請(qǐng)

知識(shí)產(chǎn)權(quán)

在中國(guó)內(nèi)地沒(méi)有經(jīng)常居所或者營(yíng)業(yè)所的外國(guó)人、外國(guó)企業(yè)或者外國(guó)其他組織在中國(guó)申請(qǐng)專利，或者作為第一署名申請(qǐng)人與中國(guó)內(nèi)地的申請(qǐng)人共同申請(qǐng)專利的，應(yīng)當(dāng)委托依法設(shè)立的專利代理機(jī)構(gòu)辦理。

Where a foreigner, foreign enterprise or other foreign organization who has no habitual residence or business office in the mainland of China applies for a patent in China, or jointly applies for a patent with an applicant in the mainland of China as the first signed applicant, it shall entrust a patent agency established according to law to handle the application.

02.專利代理

在中國(guó)內(nèi)地沒(méi)有經(jīng)常居所或者營(yíng)業(yè)所的香港、澳門或者臺(tái)灣地區(qū)的申請(qǐng)人向?qū)＠痔岢鰧＠暾?qǐng)，或者作為第一署名申請(qǐng)人與中國(guó)內(nèi)地的申請(qǐng)人共同申請(qǐng)專利的，應(yīng)當(dāng)委托依法設(shè)立的專利代理機(jī)構(gòu)辦理。

Where an applicant from Hong Kong, Macao or Taiwan, who has no habitual residence or business office in the mainland of China, files an application for a patent with the patent office, or jointly applies for a patent with an applicant from the mainland of China as the first named applicant, he shall entrust a patent agency established according to law to handle the application.

依法設(shè)立的專利代理機(jī)構(gòu)是依照專利代理?xiàng)l例的規(guī)定經(jīng)國(guó)家知識(shí)產(chǎn)權(quán)局批準(zhǔn)成立的，具體名錄及專利代理機(jī)構(gòu)的相關(guān)信息可從網(wǎng)上查閱。
