今年四川的冬天特別冷。

就在不久前，彭州大寶鎮(zhèn)九峰村一個(gè)叫“丹卉山莊”農(nóng)家樂老板，不知出于什么原因，不想支付幾萬元的修建費(fèi)，竟聲稱星河公司給他修建的房屋存在質(zhì)量問題——好了，當(dāng)?shù)亟ㄖこ藤|(zhì)量檢測(cè)中心聞風(fēng)而動(dòng)，前來進(jìn)行技術(shù)鑒定了。不知這家檢測(cè)中心出于什么目的，讓人費(fèi)解的是，國家《建筑法》83條明明規(guī)定：“搶險(xiǎn)救災(zāi)臨時(shí)建筑和農(nóng)民自建的低層房屋不適用本法。”國家又規(guī)定，3層以下房屋屬于低層建筑，而“丹卉山莊”只有2層，這樣的建筑，哪能有勞這家建筑鑒定中心風(fēng)聲鶴唳來做鑒定呢？可他們來了。

How could such building need such testing center to conduct the evaluation??But here they came.

叫人感到奇怪的是，這棟房屋完全是用輕質(zhì)建材建設(shè)，他們無視國家對(duì)這種產(chǎn)品頒發(fā)的“重點(diǎn)新產(chǎn)品”、“重點(diǎn)環(huán)保創(chuàng)新產(chǎn)品”和“國家星火計(jì)劃推廣項(xiàng)目”的結(jié)論，竟搬來鋼筋水泥和磚混結(jié)構(gòu)房屋的設(shè)計(jì)建設(shè)標(biāo)準(zhǔn)，從地基基礎(chǔ)、墻體結(jié)構(gòu)到樓面板都按常規(guī)設(shè)計(jì)建設(shè)標(biāo)準(zhǔn)來進(jìn)行鑒定。同時(shí)他們還不顧國家《建筑法》第4條的規(guī)定：“國家鼓勵(lì)獎(jiǎng)勵(lì)建筑新材料、新工藝和新技術(shù)的運(yùn)用?！比绱艘粊?，他們簡單甚至粗暴地把“丹卉山莊”鑒定為“危房”！言之鑿鑿聲稱“此房存在嚴(yán)重安全隱患，嚴(yán)重不滿足現(xiàn)行國家建筑抗震設(shè)計(jì)規(guī)范，以及建筑抗震設(shè)防烈度7度要求?！?/p>

What made people feelling strange was that the house used the lightweight building materials for construction completely, but they ignored the conclusion for this kind of product of "key new product", "key green innovative product" and "National Spark Plan Promotion Program" issued by the state, and applied the design and construction standards of reinforced concrete and brick structure buildings, to evaluate from the foundation, wall structure to the floor panels according to the conventional design and construction standards.?At the same time, they also ignored Article 4 of the National Construction Law: "The state encourages and rewards the application of new construction materials, new processes and new technologies."?In this way, they simply or even roughly identified "Danhui Mountain Villa" as a "dangerous building"!?they claimed firmly that "this house has serious potential safety hazards, and seriously does not meet the requirements of current national seismic design code, as well as building seismic fortification intensity of 7 degrees.

民間有句俗語，叫住“抬頭三尺有神靈”。意思就是說一個(gè)人做事要憑良心，不能去做昧心的事，冥冥之中頭頂上有神靈看著你呢！不知是偶然還是必然，老天后來果然給了這家建筑鑒定中心無情的嘲諷——此事說來話長，留待后述，還是讓我們回到當(dāng)前的現(xiàn)實(shí)中來。

由于這家建筑鑒定中心草率地鑒定，加之當(dāng)?shù)胤ㄔ翰活櫴聦?shí)錯(cuò)誤地判決，這家山莊不但不付分文建設(shè)費(fèi)，反而要向星河公司進(jìn)行經(jīng)濟(jì)索賠幾十萬元。如此一來，在四川農(nóng)村就產(chǎn)生了多米諾骨牌一樣的效應(yīng)——好呀，既然建筑檢測(cè)中心都說這樣的建筑是“危房”，法院判決不但可以不給錢，反而可以向?qū)Ψ剿髻r，這樣的好事真是千載難逢！于是，一時(shí)間，星河公司已建和在建的工程，幾乎都被卷到拒付建設(shè)款和經(jīng)濟(jì)索賠的官司之中。
