Proud to lose for right protection

2003年3月20日，他將一紙訴狀遞給了四川某法院，要求判定郵政局商函公司賠償損失3000萬元。訴狀遞到法院，單是等著立案，就等了4個月，其理由是要補充證據。周興和與律師四處奔波，用了很多時間來補充證據。

On March 20, 2003, he handed a petition to a court in Sichuan Province, asking the business letter company of the post office to pay 30 million yuan for compensation. The pleadings were brought to the court and waited four months just to be filed, on the grounds that they needed additional evidence. Zhou Xinghe and his lawyer were on the move, spending a lot of time supplementing the evidence.

2003年7月28日，星河公司才接到法院的立案通知書。在交了法院12.4萬元的案件受理費和其它訴訟費后，案件才得以審理。

On July 28, 2003, Xinghe Company received a notice of litigation from the court. After paying 124,000 yuan for the litigation fee and other legal costs, the case was heard.

一審判決認為這是一起刑事案件，犯罪人已得到處理，所以判星河公司敗訴，并賠償郵政局郵費10多萬元。星河公司不服，當庭表示上訴。2005年初才在上一級法院立案，遲遲結不了案。

The first judgment considered that this was a criminal case and the offenders had been dealt with, so it ruled against Xinghe Company and compensated the post office for the postage of more than 100,000 yuan. Xinghe Company refused to accept and said it would appeal against the judgement. At the beginning of 2005, the case was filed in the higher court and could not be closed for a long time.

直到2005年底，法院二審又判決星河公司敗訴，其理由是信函里裝的商業(yè)資料是“非法印刷品”。

Until the end of 2005, the court ruled against Xinghe Company in a second trial, arguing that the business materials contained in the letters were the "illegal publication".

星河公司為兩次官司又付出訴訟費、律師費100多萬元。他們當年投資2000多萬元做廣告，計劃創(chuàng)收1.5億元，結果還倒賠了2000多萬元！?

Xinghe Company had spent more than 1 million in legal fees and attorney fees for the two lawsuits. They invested more than 20 million yuan in the advertisement that year and planned to generate 150 million yuan in revenue, but they turned out to lose more than 20 million yuan!

“打這場官司，雖然把我們拖得筋疲力盡，但更讓我更學會了怎樣與司法部門打交道，同時也讓全國人民知道了四川有個生產綠色建材的星河公司。我相信，打這樣有巨大社會影響的官司，將會促進我國法律的完善進程！”周興和總結這場曠日持久的官司時說道。

"The lawsuit exhausted us, but it helped me learn more about how to deal with the justice department and let the whole country know that there is a company in Sichuan that produces the green building materials. I believe that fighting such a lawsuit with great social impact will promote the improvement of the law of our country!" Zhou Xinghe said, summing up the protracted legal battle.
