綁架罪的構(gòu)成要件包括客體、客觀方面、主觀方面和處罰?？腕w是復(fù)雜客體，包括他人的人身自由權(quán)利、健康、生命權(quán)利及公私財產(chǎn)所有權(quán)利?？陀^方面表現(xiàn)為使用暴力、脅迫或者其他的方法，綁架他人的行為。主觀方面由直接故意構(gòu)成，并且具有勒索財物或者扣押人質(zhì)的目的。處罰根據(jù)《刑法》第二百三十九條規(guī)定，以勒索財物為目的綁架他人的，或者綁架他人作為人質(zhì)的，處十年以上有期徒刑或者無期徒刑，并處罰金或者沒收財產(chǎn)；情節(jié)較輕的，處五年以上十年以下有期徒刑，并處罰金。

The constitutive elements of kidnapping include object, objective aspect, subjective aspect and punishment. Object is a complex object, including other people's personal freedom rights, health, life rights and public and private property rights. The objective aspect is to use violence, coercion or other methods to kidnap others. The subjective aspect consists of direct intent and has the purpose of extorting property or taking hostages. Whoever, in accordance with the provisions of Article 239 of the Criminal Law, kidnaps another person for the purpose of extorting money or property, or kidnaps another person as a hostage, shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment. A fine or confiscation of property shall also be imposed; if the circumstances are relatively minor, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years and shall also be fined.
