在特殊的學(xué)校里
In the special school
坐牢,周興和這一輩子連做夢也沒想到。
In prison, Zhou Xinghe never thought of it all his life.
父母親一輩子盡管窮愁潦倒,但他們都是老實本分的農(nóng)民。他們寧愿餓死凍死,也是絕不會越雷池一步的。父親在的時候,盡管他說不出什么大道理,但經(jīng)常教育周興和的一句話就是“毒人的藥不吃,犯法的事不做”;還有一句就是“為人不做虧心事,半夜不怕鬼敲門”。
Although his parents were poor and down-and-out all their lives, they were honest farmers. They would rather die of hunger and cold than cross the line. When his father was alive, although he could not make any great sentence, he often taught Zhou Xinghe that: "Do not eat poison, do not do illegal things"; and "A good conscience is a soft pillow".
平時,周興和見到戴大蓋帽的公安,似乎還有幾分膽怯;路過公檢法機關(guān)門口,他連頭也不抬一下,心想我周興和又不犯法,這輩子也絕不會和這些地方打交道——可,你不想和他打交道,他卻要找上門來!世事的變遷,那是不以人的意愿為轉(zhuǎn)移的。
At ordinary times, when Zhou Xinghe saw the policeman wearing a big hat, he seemed a little timid. When he passed by the door of the public security organ, he did not even raise his head, thinking that Zhou Xinghe was not a lawbreaking man and would never enter these places in his life. However, even if you did not want to enter here, it would come to you! The vicissitudes of the world do not follow the will of the people.
周興和剛進監(jiān)獄時,他心情煩躁到了極點。從小他雖說生活艱難,經(jīng)常挨凍受餓,但他卻擁有自己的自由。他能上山捉蝴蝶,下田逮泥鰍;他能下街去趕場,上坡去打柴。哪怕就是前些年,公社“群?!钡娜藥状闻匪?,但也沒有正經(jīng)地把他關(guān)進牢房呀!
When Zhou Xinghe firstly went to prison, he was extremely upset. Although he had a hard life, often having cold and hungry, he still had his freedom. He can catch butterflies in the mountains and loach in the fields. He could go down the street to the fair, and up the hill to the wood. Even a few years ago, the people of the commune criticized him several times, but they did not put him in prison seriously.
這里,吃霉米睡地鋪倒還罷了,房間狹窄空氣污濁也罷了。最使人難以忍受的,就是在這有限的空間里,除了鐵門上那個可憐的窗洞,四周全都密不透風(fēng),高墻和鐵門把世界上所有的陽光空氣都與這里隔絕起來。牢室里,白天無光,夜里卻有燈。同時,關(guān)押在這里的人,天天還要無緣無故被人喝斥,屙屎屙尿都要請示報告——失去自由的滋味,真他媽比被人一槍斃了還難受??!
Here, eating the mildew rice and sleeping on the floor, and even the narrow room and dirty air were all acceptable. What the most intolerable was that in this confined space, except for the poor window-hole in the iron gate, all around was impenetrable, and the high wall and the iron gate closed off from all the sunshine and air of the world. Inside, there was no light by day, but a lamp on by night. At the same time, the people who are imprisoned here were scolded every day for no reason, and their excrement and urine should be reported. The taste of losing freedom was worse than being executed by shooting.
我到底犯了法律上的那一條呢?周興和想來想去想不明白,他感到滿腹的委屈、冤枉、煩躁,有時甚至憤怒起來!
Which law did I break? Zhou Xinghe thought over and over. He felt full of grievance, injustice, irritability and sometimes even anger.
“黨的政策你知道,坦白從寬,抗拒從嚴(yán)。”剛進檢察院時,檢察官給他交代政策,“你到這里來,就要老老實實把問題交代清楚!”
"The Party's policy, as you know, is to be lenient in frankness and strict in resistance." When he firstly entered the procuratorate, the procurator told him the policy: "When you come here, you must give a clear account for you problem honestly!"
“我除了在地里做莊稼,就是正正經(jīng)經(jīng)做生意,不曉得犯了哪樣法,你們要叫我到這里來?!睓z察官的問話,讓周興和摸不著頭腦。
"I do not know what law I have committed; I just plant crops in the fields and do business in earnest. You get me here." The prosecutor's question left Zhou Xinghe scratching his head.
“我們也不想跟你繞圈子,你給人行賄的事,把它交代清楚!”
"We don't want to beat around the bush with you, either. Tell us about the bribe you gave to someone!"
“行賄?”周興和更是云里霧里不知所云,他從來沒聽說過還有“行賄“這個犯法的詞兒。
"Bribe?" Zhou Xinghe was at a loss. He had never heard of the illegal word "bribe".
“就是你給人家送了多少禮,送禮多少錢?!睓z察官見他一臉誠實,確實不是裝癡作啞,才把法律條款拿給他看。說實話,他在看那法律條文時,上面的“賄賂”兩個字,他還不認識。
"It means how many gifts you give and how much money you give to others." The prosecutor, seeing that his face was honest, and that he was not pretending to be dumb, showed him the terms of the law. To tell the truth, when he read the article of the law, the word "bribery" was not yet recognizable to him.
“送錢?行賄?”周興和想了想,懵懂知道了這個詞的涵義,但他還是忍不住又問,“送禮就是送禮,送錢就是送錢,怎么又和‘行賄’拉扯在了一起?說實話,逢年過節(jié),我經(jīng)常都給親戚、長輩送禮送錢,難道都犯法了么?”
"Sending money? Bribery?" Zhou Xinghe thought over, muddledly understanding the meaning of the word, but he could not help asking again, "Gift is gift, sending money is sending money, how could it relate to 'bribery'? To tell the truth, I often give gifts and money to my relatives and elders during the holidays. Is that a crime?"
“跟親戚、長輩送錢送禮是一回事,但為了個人不可告人的目的,拉攏腐蝕國家工作人員,這送錢送禮又是另一回事!”檢察官說著說著嚴(yán)厲起來,他提高了聲音,“你別給我們兜圈子了!說,你到底給哪些人送了錢?送的數(shù)額是多少?”
"It is one thing to send money and gifts to your relatives and elders, but it is another thing to send money and gifts to corrupt the state functionaries for your personal hidden purposes!" The prosecutor spoke sternly, and he raised his voice, "Don't beat about the bush! Tell us, who exactly did you send money to? What's the amount?"
周興和這一下終于醒悟過來:自己給人送錢,既然都犯了法,那收了他錢的人,肯定更犯了法。如果自己把他們說出來,他們不是也要到這檢察院來坦白交代么!人家在生意上幫了自己的忙,送的錢雖不多,但人家沒來敲詐自己,是自己自覺自愿送人家的;如果把他們交代出來,讓人家丟掉官位丟掉飯碗,那不就是落井下石,太不仁義太不義氣了么!
At last, Zhou Xinghe came to his senses: since he had broken the law by giving money to others, the one who had received his money must also have broken the law. If he spoke out, they would come to the procuratorate to confess too! The other person helped him in the business; although the money sent was not much, the other person did not blackmail him, and it was his own willingness to send money; if I give them up and make them lose their positions and their jobs, it would be a cruel and unjust act.
周興和是個倔犟的人,他認準(zhǔn)了的死理,就是十條牯牛也拉不回來。想到這里,無論檢察官再怎么問,他都緘口不語了。
Zhou Xinghe was such a stubborn man that even ten cattle could not bring his mind back. No matter what the prosecutor asked him, he remained silent then.
“你想包庇這些人是不行的,這對你沒有任何好處!”檢察官嚴(yán)厲地對他說道,“我們是能夠調(diào)查清楚的!”
"You can't cover up these people, and it won't do you any good!" Said the prosecutor sternly to him, "We will find it out!"
周興和抱定了一個宗旨,任隨你怎么發(fā)問,他都一言不發(fā)。
Zhou Xinghe stuck to his determination and would never say a word to any question.
“你這個人還真是頑固?!弊詈螅瑱z察官不想和他費口舌了,遞給他一張《收容審查證》,“在這上面簽上名,按上你的手印!”
"You are really stubborn." Finally, the prosecutor, not wanting to argue with him any more, handed him a Reception Permit for Investigation, "Sign your name here in person, and print your handprint on it!"
于是,周興和被送到了看守所來。
So, Zhou Xinghe was sent to the detention house.
后來周興和才知道,原來,那三個生意上的合伙人投靠他以后,他們共同經(jīng)營才5個月的時間,到1987年8月,他們四人已經(jīng)每人分得17萬利潤。照道理,生意做好了,應(yīng)該是皆大歡喜的事,可偏偏卻生出莫名的意外來了!一個和他同做生意姓李的朋友,為人奸詐心胸狹隘,他串通其他兩個合伙人,共同告發(fā)了周興和行賄的事情——好啊,周興和進了監(jiān)獄,他們自然就除掉了生意上最強悍的競爭對手,就可以輕易壟斷此地木材銷售的天下了!
Later, Zhou Xinghe found out that the three business partners had been working together for only five months after they joined him, had each received 170,000 yuan in profits by August of 1987. Generally, if the business was done well, it should be a happy thing for everyone, but it just gave rise to inexplicable accident! One friend who did business with him, surnamed Li, was treacherous and narrow-minded. He had conspired with other two partners to report on Zhou Xinghe’s bribery - well, Zhou Xinghe went to prison, and of course they got rid of their strongest competitor and could easily dominate the timber market here!
商場上波云詭譎,陷阱叢生。初涉商海的周興和,由于他的義氣和善良,讓他栽了個大跟斗!
The market is treacherous and full of traps. The zhou Xinghe that enters business sea at the beginning, because of his loyalty and kindness, let him fall a big heel!
天黑了又亮了,天亮了又黑了。沉悶、枯燥、憋屈、憤懣,失去自由的日子真的太難熬了,日復(fù)一日就呆呆地看著不明不白的日光,從墻壁的這邊慢慢移到那邊,然后在昏暗的燈光下,閉上眼睛做著無數(shù)渾渾噩噩光怪陸離的夢。
It got dark, then dawn, then dark again. Depressed, dull, oppressed, resentful, the loss of freedom was really too difficult to endure; day after day, he gawked at the hazy daylight, slowly moving from one side of the wall to the other, and then in the dim lamp light, closed his eyes and had a lot of aimless and strange dreams.
進來一段時間后,檢察院的人再也沒來提審過他,獄室里的犯人見新來的這個人整天沉默寡言,也摸不透他的底細,所以也并沒有欺負他。既來之則安之,過了大約半個月,周興和才慢慢適應(yīng)了這里的環(huán)境,心境才開始慢慢平靜下來。
After he had been there for some time, no one from the prosecutor's office came to question him, and the prisoners in the prison cell had no idea who he was, who was silent all day, and did not bully the newcomer. After about half a month, Zhou Xinghe gradually got used to the environment here and began to calm down.
心情平靜下來的周興和,有一天,他不知是哪根神經(jīng)發(fā)了岔,突然非常強烈地想讀書!算起來,他失學(xué)已經(jīng)20多年了,這些年來為了一家人的生存,他拼死累活,流離顛沛,哪里有時間和精力來讀書呀!這幾年,每當(dāng)他看見孩子們背著書包蹦蹦跳跳上學(xué)時,他就想起自己苦澀的童年和少年,除了對那些上學(xué)的孩子充滿羨慕,他更多的是感到一陣陣辛酸——而今在這牢房里,雖說諸事不如人意,但寂寞清靜,百無聊賴,這是多么好的讀書機會呀!
Since his mood calmed down, one day, Zhou Xinghe himself did not know why, suddenly had a very strong will to study! He had been out of school for more than 20 years. For the sake of the survival of his family, he had worked his ass off and travelled from place to place. How could he have any time and energy to study? In recent years, whenever he saw the children were prancing about carrying a bag to go to school, he recalled his bitter childhood and youth; except for envying those school children, he felt more about bitterness - and now in the cell, although nothing was satisfied, it was quiet, lonely and bored, and was a good chance to study!
想到這里,他突地翻身從草鋪上坐了起來,走到門洞邊,向管理人員報告了自己的要求。
At this thought, he rose abruptly from his straw mat, walked to the gate, and reported his request to the steward.
那時,監(jiān)獄里盡管沒有圖書室,但有關(guān)黨和政府政策方面的政治書、為教育改造犯人的法律書還是有的。周興和首先選定的就是學(xué)習(xí)法律書。在那里,他利用這難得的時間,從早到晚如饑似渴地學(xué)習(xí)起《憲法》、《刑法》、《刑事訴訟法》、《民法訴訟法》等各種法律來。通過系統(tǒng)的學(xué)習(xí),久而久之,讓他大開眼界,甚至還興奮不已。
At that time, although there was no library in the prison, there were political books on the party and government policies, and legal books on the education of prisoners. Zhou Xinghe's first choice was to study the law books. There, he used this rare time to study the Constitution, the Criminal Law, the Criminal Procedure Law, the Civil Procedure Law and other laws from morning till night with great eagerness. Through the systematic learning, as time passed, it widened his horizon and even excited him.
“我還真要感謝那位讓我坐班房的朋友,如果不在那特殊的學(xué)校呆了將近一年,我就不會有今天的成就。在班房里,我認真系統(tǒng)地學(xué)習(xí)了法律知識,使我從一個法盲成為比較精通法律的企業(yè)家?!?007年6月,周興和在四川大學(xué)的講壇上,他提到這段難忘的經(jīng)歷,他告訴同學(xué)們,“法律這東西,就跟用電一樣。如果你不懂電,它可能燒死你;反之,它就可以為你服務(wù)。法律也是一樣,你不懂法,就可能觸犯法律;反之,你可以用法律來保護自己,也可以打法律的擦邊球,來跟司法腐敗分子走‘貓步’!”
"I really want to thank my friends who put me in prison. I wouldn't be where I am today if I hadn't been in that special school for almost a year. In the cell, I studied the law knowledge carefully and systematically, which made me become a legalistic entrepreneur proficient in law from the legal illiterate." Speaking from the platform at Sichuan University in June of 2007, Zhou Xinghe told the students that, "The law is just like electricity. If you don't understand how to use the electricity, it may burn you to death. Instead, it works for you. The law is the same. If you don't know the law, you may break it. Instead, you can use the law to protect yourself, or you can play the edge ball of the law, to do the 'catwalk' with judicial corrupt elements!"
就是這段難忘的牢獄生活,增強了他的法律意識,使他在后來的幾十年中孜孜不倦學(xué)習(xí)和鉆研法律知識,2007年他還破例獲得法制專家證書。
It was this unforgettable prison life that enhanced his legal awareness and enabled him to study and delve into the legal knowledge tirelessly in the following decades. In 2007, he obtained the legal expert certificate as an exception.
除了學(xué)習(xí)法律,為了消磨時光,周興和開始用圓珠筆學(xué)習(xí)畫畫。畫人物、畫山水、畫靜物,前后畫了50余幅畫。令人驚異的是,他在這方面竟具備較強的天賦,無師自通。筆者今天所看到的,他在監(jiān)獄畫的那些素描,完全可以和剛進美術(shù)??茖W(xué)校的學(xué)生媲美。
In addition to studying the law, Zhou Xinghe began to learn to draw with a ballpoint pen to kill time. He painted the figure, landscape and still life. He had painted more than 50 drawings in succession. It was amazing that he had a strong talent in this aspect. What I see today, those sketches he made in prison, can be as good as the students who just entered the academy of fine arts.
在監(jiān)獄里整整呆了11個月,到第二年秋天,他的問題終于審查清楚。說起來,無非就是一個不懂法的農(nóng)民為了維持生計,給人送了一點錢就是了,所以他被司法機關(guān)無罪釋放了——但,他剛跨出高墻,他婚姻的危機卻已在醞釀之中了。
He spent eleven months in prison, and by the fall of the next year his problems were finally investigated clearly. It was nothing more than a farmer who didn't know the law and gave other people a little money to make ends meet, so he was acquitted by the judicial authorities - but as soon as he stepped out of the prison wall, his marital crisis was brewing.
